Marion Planning Board takes up Heron Cove Estates, a plan for up to 57 townhomes on Route 6, on Monday

The site plan shows 55 townhomes on three lots zoned Residence D. Two town boards take up the project this week, the Planning Board on Monday and the Conservation Commission on Wednesday.

MARION A plan for up to 57 townhomes on Marion's stretch of Route 6 goes before the Planning Board on Monday. The board's Oct. 19 agenda lists a site plan application for Heron Cove Estates on Wareham Street, Map 7, Lots 28, 28A and 28B, "for proposed construction of up to 57 townhomes, 55 as shown on the site drawings." The land is zoned Residence D, the agenda says. The Planning Board agenda does not name the developer; the Conservation Commission's Oct. 21 agenda lists the applicant as Heron Cove Estates, LLC.

How site plan review works

The item sits under the agenda's heading for public hearings and meetings. Under the Planning Board's posted rules for site plan review, a complete application gets a public hearing within a month. The hearing notice runs in two consecutive issues of The Wanderer or another local paper, at least 14 days before the hearing opens, and the Planning Office notifies abutters within 300 feet by certified mail.

The same rules have the board send the application to other town departments for comment within five days of receiving it: the Conservation Commission, Board of Health, Department of Public Works, building commissioner, Marine Resources Commission, fire chief and police chief, as appropriate. The board must take a final vote within 60 days of receiving the application, unless the applicant asks in writing for more time. A 20-day appeal period follows the decision, the rules say.

What the records show

The project first came before the board Oct. 5, when the agenda listed a pre-submission conference on the same plan, with the same wording on the number of townhomes. Under the board's rules, that informal step is where the board reviews what the applicant must file and sets the filing fee. The Oct. 19 agenda lists approval of the Oct. 5 minutes, but those minutes had not been posted on the town's agenda center when we checked Sunday.

The posted agendas do not give a price range, the number of bedrooms, whether any homes would be set aside as affordable, or how the homes would get water and sewer service. The application and site drawings were not posted with the agenda.

A second board weighs in

The Conservation Commission takes up the project Wednesday. Its Oct. 21 agenda lists, under correspondence, a request for comment from the Planning Board regarding Heron Cove Estates, LLC on Wareham Street. No public hearing on the project is listed on the commission's agenda.

Other business Monday

Monday's agenda also lists a request for a bond reduction from Toll Brothers Inc. for 78 Wareham Road. Field Engineering peer review invoices on that project appeared on three of the board's posted agendas since August, each to be paid from Toll Brothers' review account under Chapter 44, Section 53G of state law: $413.69 on Aug. 3, $1,238 on Sept. 21 and $2,078.28 on Oct. 5. Together that is $3,729.97.

The board will also continue its public meeting on Sippican Holdings' plan to expand an existing building at 14 Barnabas Road, in the Limited Industrial District, consider a $2,800 Chappell Engineering Associates peer review invoice on that project and discuss a peer review checklist.

Housing letters this week

The Marion Select Board's Oct. 20 agenda lists a letter from the Town of Dartmouth "Regarding Local Planning in State Housing Policy." In Westport, the Select Board on Oct. 19 considers signing a joint letter from towns to the state on local planning in state housing.

How to take part

The Planning Board meets at 7 p.m. Monday in the Marion Police Department conference room, 550 Mill St. The meeting is televised and streamed live on Old Rochester Community Television. To join remotely through Microsoft Teams, email Jenna Riewer at jriewer@marionma.gov during regular Town Annex business hours, the agenda says. The Conservation Commission meets at 7 p.m. Wednesday in the same room, with the same remote option. The Planning Board's next meeting is Nov. 2.

How we verified this

Every fact comes from the town's posted Planning Board, Conservation Commission and Select Board agendas, the Planning Board's posted site plan review rules, and one Westport agenda, listed below. We read them on Oct. 18. We checked each date and weekday against a calendar and checked each claim against the documents. Not heard: no one was contacted.
