MATTAPOISETT Two housing proposals tied to Dennis Mahoney & Sons Inc. go before Mattapoisett boards this month. The Planning Board gets an informal first look Monday, Oct. 19, at a two-phase Special Residential Development at Nicky's Lane and Deerfield Road. On Oct. 28 the Conservation Commission continues its hearing on a plan to rebuild seven homes on one lot on Mahoney's Lane, and it has moved that session to the Old Rochester Regional High School auditorium because it expects people to attend in person.
That puts one company's plans before two boards in nine days. The Mahoney's Lane project is before the commission as a notice of intent, the filing the state Wetlands Protection Act requires for work in or near wetlands, so any terms for the work will come from the commission. Neither set of plans is attached to the agendas or posted elsewhere on the town website.
Monday: Nicky's Lane and Deerfield Road
The Planning Board notice, stamped by the town clerk Oct. 15, lists an informal meeting on land at Map 21, Lots 33 and 42B, owned by Dennis Mahoney & Sons Inc. The scope of work reads: "A proposed 2-phase Special Residential Development." No public hearing or vote is listed. Town Planner Victoria Alfaro posted the notice for the board, which Thomas M. Tucker chairs.
The zoning bylaw posted on the town website defines a Special Residential Development, or SRD, as "a residential development of three or more detached single-family dwellings or semi-attached dwellings or townhouse dwellings or combination thereof" on land divided into lots for homes and open space. An SRD needs a special permit from the Planning Board, and the bylaw says that permit "shall not be a substitute for compliance" with the board's subdivision rules. A formal filing would have to clear both.
The number of homes is not fixed in advance. Under the bylaw, an SRD cannot exceed what a conventional subdivision of the same land would produce in building coverage, number of occupants and daily car trips. The board may add a density bonus of up to 20% for exceptional open space, public improvements, homes restricted to people over 55, or affordable units.
The company has tried the format before. In July, a preliminary subdivision at 182 North St., Kindred Estates, on company-owned land, was listed as a four-lot SRD. By Aug. 3 the agenda described it as a "Proposed 3-lot subdivision to be served by a common driveway, formerly a proposed 4-lot Special Residential Development (SRD)."
Oct. 28: Mahoney's Lane
The Conservation Commission first listed the company's notice of intent for 1-7 Mahoney's Lane, Map 10, Lot 54, on its July 13 agenda. The applicant "proposes to reconstruct seven Single-Family Dwellings on a single lot," the agendas say, with Schneider, Davignon & Leone Inc. as its representative. The hearing before the commission, chaired by Michael King, is state file SE44-1617 and was continued from July 13 to Oct. 28.
The commission normally meets at Town Hall, 16 Main St., and its Oct. 14 session there was hybrid. The Oct. 28 session at 135 Marion Road will take up only the Mahoney's Lane project and will be in person only. The commission's web page says there will be no Zoom option "due to the location necessary for the expected in person participation." Residents who cannot attend "are encouraged to share their comments or concerns by submitting a letter in advance," by email to Conservation Commission Administrator Megan Gonzalez at mgonzalez@mattapoisett.gov or by mail to Town of Mattapoisett, Conservation Commission, P.O. Box 435, Mattapoisett, MA 02739.
The posted agendas do not say which wetland areas border the site or what the reconstruction involves. The commission can continue the hearing again, or close it and then issue an order of conditions setting terms for the work, or a denial.

How we verified this
Every fact comes from the Town of Mattapoisett's posted Planning Board and Conservation Commission agendas and notices, the Conservation Commission's web page, the zoning bylaw on the town website and the state Wetlands Protection Act, listed below. We read them on Oct. 18. The zoning bylaw file on the site is dated 2021, and later amendments may not be shown. We checked each date and weekday against a calendar and checked each claim against the documents. Individual applicants listed on the agendas are left out. Questions for the Planning Board office and the Conservation Commission are logged but have not been sent. Not heard: no one was contacted.
