Prosecutors have asked a judge to order Wareham police officer Ryan G. Gomes held before trial as a danger to others, and a hearing on the request is set for Friday, Oct. 30, at 2 p.m. in Wareham District Court, according to the court's docket in the case.

The Commonwealth filed its dangerousness motion at Gomes' arraignment on Monday, Oct. 26, and the hearing was continued to Friday, to be held in person, a handwritten docket entry shows. Gomes pleaded not guilty to all charges and is being held without bail, NBC Boston reported. He is presumed innocent unless proven guilty in court.

What the docket shows

The criminal complaint, docket number 2660CR001616, was issued Oct. 26 and lists 18 counts. The docket pages the court sent South Coast 360 list 16 of the 18 counts: 13 counts of assault with a dangerous weapon, one count of strangulation or suffocation, one count of assault and battery on a family or household member and one count of rape.

The docket names the investigating agency as the Massachusetts State Police, Yarmouth. NBC Boston reported that state police detectives assigned to the Cape and Islands District Attorney's office handled the case. The Massachusetts Peace Officer Standards and Training Commission suspended Gomes' certification on Tuesday, Oct. 27, the station reported.

South Coast 360 does not identify people who report sexual assault or domestic abuse, and this story leaves out details that could identify the person who made the report.

What a dangerousness hearing decides

Under Chapter 276, Section 58A, of the General Laws, prosecutors may ask for a person to be held before trial, or released only on conditions, when the person is charged with a felony that involves the use, attempted use or threatened use of physical force against another person, among other listed offenses. The hearing is held at the person's first appearance unless the person or the prosecution asks for a continuance, and the person is held during a continuance if there was probable cause for the arrest.

To order someone held, the judge must find by clear and convincing evidence that no conditions of release will reasonably assure the safety of any other person or the community, the law says.
